Supplementary Terms and Conditions – Lionel Messi Signed Boot

These Supplementary Terms and Conditions (“Supplementary Terms”) apply specifically to the auction item titled “Lionel Messi Signed Boot” (the “Item”), offered as part of the Pho3nix Foundation’s charity auction (the “Auction”) hosted on the Givergy platform. By placing a bid on this Item, each participant (“Winner” or “Bidder”) agrees to be bound by these Supplementary Terms, in addition to Givergy’s general Auction Terms and Conditions and any applicable terms published on the Pho3nix Foundation website.

1. Nature of the Item
   1.1. The Item consists of one (1) football boot signed by Lionel Messi, as described in the auction listing.
   1.2. The boot that you receive may be slightly different in design and colour to the image used in promotional materials.
   1.3. This Item is offered as a collectible memorabilia piece. It is not intended for competitive or recreational sporting use.
   1.4. The winning bid is a charitable donation in support of Pho3nix programs. This Item may not be exchanged for cash or other goods or services.
2. Condition and Inspection
   2.1. All prizes are offered in good faith and are non-refundable under any circumstance.
   2.2. No warranty is given regarding the condition of the Item beyond the description in the auction listing.
   2.3. The Bidder is deemed to have relied on the description provided in the auction listing (including any reference images) in making their bid. Pho3nix will not be responsible for any perceived variation from promotional images.
3. Delivery
   3.1. The Item will be delivered to the Winner within a reasonable timeframe after the Auction concludes.
   3.2. Any applicable customs duties, taxes, or import fees are the responsibility of the Winner.
4. Donation Terms
   4.1. The donation is non-refundable under any circumstances, including but not limited to:

• Dissatisfaction with the Item
• Minor differences in design or colour from promotional images
• Any damage occurring after delivery to the Winner
  4.2. The donation is non-transferable, except with prior written consent from Pho3nix.

1. Publicity and Use of Images
   5.1. Pho3nix may publicly acknowledge the Winner unless they opt out by written notice within 7 days of the Auction’s conclusion.
   5.2. Images of the Item may be used for promotional purposes before or after delivery.
2. Liability and Disclaimers
   6.1. To the fullest extent permitted by law, Pho3nix and all related partners disclaim all liability for any loss, damage, or injury arising from or related to possession or use of the Item, except where caused by gross negligence.
   6.2. Under no circumstances shall Pho3nix, its directors, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, or punitive damages in relation to this Item.
3. Jurisdiction and Governing Law
   7.1. These Supplementary Terms shall be governed by the laws of Switzerland.
   7.2. Any disputes arising in connection with this Item shall be subject to the exclusive jurisdiction of the courts of Switzerland.
4. Severability
   If any provision of these Supplementary Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
5. Entire Agreement
   These Supplementary Terms, together with Givergy’s general Auction Terms and Conditions, constitute the entire agreement between Pho3nix and the Winner in relation to this Item.
