Auction Item 13 Terms & Conditions
These Supplementary Terms and Conditions (“Supplementary Terms”) apply specifically to the auction item titled “Pho3nix Ambassador School Visit” (the “Experience Lot”), offered as part of the Pho3nix Foundation’s charity auction (the “Auction”) hosted on the Givergy platform. This Experience Lot will be awarded to the highest bidder in the silent auction. By bidding on this Experience Lot, each participant (“Winner” or “Bidder”) agrees to be bound by these Supplementary Terms, in addition to Givergy’s general Auction Terms and Conditions and any applicable terms published on the Pho3nix Foundation website.
- Nature of the Experience
1.1. This Experience Lot entitles the Winner to arrange a one-day visit by a Pho3nix Foundation Ambassador to a school of their choosing within Europe.
1.2. The visit will include:
- A live, age-appropriate presentation by the Ambassador
- An interactive movement or sports workshop
- A Q&A session with students and staff
- A signed gift for the school and photo opportunities
1.3. The winning bid is a charitable donation to support Pho3nix programs. This lot is not exchangeable for cash or other goods and services.
- Availability and Scheduling
2.1. Ambassador selection is subject to availability at the time of booking. Pho3nix will work with the Winner to confirm a suitable Ambassador from its current roster.
2.2. The date of the visit will be mutually agreed between the Winner, the school, and Pho3nix, taking into account the Ambassador’s schedule and other commitments.
2.3. The visit must take place within 12 months of the Auction’s conclusion, unless otherwise agreed in writing by Pho3nix. - Location and Access
3.1. The visit is available only for schools located within Europe.
3.2. The Winner is responsible for ensuring the school has provided written consent to host the visit and that the venue meets any requirements for the planned activities.
3.3. Pho3nix reserves the right to decline or cancel the visit if it deems the location unsuitable for safety, logistical, or reputational reasons. - Costs Covered
4.1. This Experience Lot includes reasonable travel and accommodation expenses for up to two Ambassadors within Europe.
4.2. Any additional costs (e.g., venue hire, catering, insurance) are the responsibility of the Winner or the hosting school. - Participation Requirements
5.1. The Winner must be aged 18 years or older at the time of bidding.
5.2. The Winner may nominate a school but must have authority or permission from the school’s administration to arrange the visit. - Donation Terms
6.1. The donation is non-refundable under any circumstances.
6.2. The donation is non-transferable, except with prior written consent from Pho3nix.
6.3. If the visit cannot be delivered due to circumstances beyond Pho3nix’s control (including but not limited to illness, travel restrictions, or force majeure), Pho3nix may, at its sole discretion, reschedule the visit or apply the donated funds to other Pho3nix Foundation programs that align with its mission. - Media and Promotion
7.1. The Winner agrees that photographs and/or videos from the visit may be taken and used by Pho3nix for promotional, marketing, and reporting purposes, unless otherwise agreed in writing.
7.2. The Winner and the hosting school may also capture and share content from the visit, provided that it is used in a respectful manner and credits Pho3nix and the Ambassador. - Liability and Disclaimers
8.1. The school is responsible for ensuring the safety and supervision of students during the visit.
8.2. To the fullest extent permitted by law, Pho3nix, the Ambassador(s), and all related partners disclaim all liability for any loss, damage, injury, or death arising from or in connection with the visit. - Jurisdiction and Governing Law
9.1. These Supplementary Terms shall be governed by the laws of Switzerland.
9.2. Any disputes arising in connection with this Experience Lot shall be subject to the exclusive jurisdiction of the courts of Switzerland. - Severability
If any provision of these Supplementary Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect. - Entire Agreement
These Supplementary Terms, together with Givergy’s general Auction Terms and Conditions, constitute the entire agreement between Pho3nix and the Winner in relation to this Experience Lot. By placing a bid, the Winner acknowledges and agrees that no additional promises, representations, or assurances outside of these written terms have been relied upon.
